यदि पुलिस आपकी शिकायत दर्ज ना करे तो क्या है आपके पास विकल्प?

यदि आपकी शिकायत पर पुलिस कोई कार्रवाई नहीं करती है, तो कानून आपको आगे बढ़ने के कई वैधानिक विकल्प प्रदान करता है। सही प्रक्रिया अपनाने से आपकी शिकायत का रिकॉर्ड सुरक्षित रहता है और आगे की कानूनी कार्रवाई में सहायता मिलती है।

1. पुलिस थाना में शिकायत दर्ज करें: सबसे पहले संबंधित पुलिस थाने में अपनी लिखित शिकायत जमा करें और उसकी प्राप्ति (रसीद/डायरी नंबर) अवश्य प्राप्त करें। इस प्राप्ति को भविष्य के लिए सुरक्षित रखें।

2. यदि थाना प्राप्ति देने से इंकार करे: यदि पुलिस थाना आपकी शिकायत स्वीकार नहीं करता या प्राप्ति देने से मना करता है, तो संबंधित जिला पुलिस अधीक्षक (SP) कार्यालय में स्वयं जाकर शिकायत दर्ज करें और उसकी (रसीद/डायरी नंबर) अवश्य प्राप्त करें। इस प्राप्ति को भविष्य के लिए सुरक्षित रखें।

3. डाक द्वारा शिकायत भेजें: आप चाहें तो अपनी शिकायत पुलिस थाना एवं जिला पुलिस अधीक्षक, दोनों को रजिस्टर्ड पोस्ट या स्पीड पोस्ट के माध्यम से भी भेज सकते हैं। ऐसी स्थिति में डाकघर की रसीद तथा भेजे गए शिकायत-पत्र की एक प्रति अपने पास सुरक्षित रखें। यह आगे साक्ष्य के रूप में उपयोगी हो सकती है।

4. उचित समय तक प्रतीक्षा करें: शिकायत प्राप्त होने के बाद पुलिस को आवश्यक कार्रवाई के लिए उचित अवसर दें। यदि लगभग 8 दिनों तक कोई कार्रवाई नहीं होती या आपको कोई संतोषजनक उत्तर प्राप्त नहीं होता, तो आप अगले कानूनी विकल्प पर विचार कर सकते हैं।

5. प्राइवेट कम्प्लेंट दायर करें: यदि पुलिस द्वारा कार्रवाई नहीं की जाती है, तो आप अपने क्षेत्राधिकार वाले लोअर कोर्ट के समक्ष प्राइवेट कम्प्लेंट प्रस्तुत कर सकते हैं। यदि संभव हो, तो किसी अधिवक्ता की सहायता से आवेदन तैयार कर न्यायालय में प्रस्तुत करें।

मजिस्ट्रेट आपके आवेदन एवं उपलब्ध साक्ष्यों का परीक्षण करेंगे। यदि उन्हें प्रथम दृष्टया मामला उचित प्रतीत होता है और जांच आवश्यक लगती है, तो वे कानून के अनुसार पुलिस को जांच करने अथवा अन्य उपयुक्त आदेश पारित कर सकते हैं। इसके बाद आगे की कार्यवाही न्यायालय की निगरानी में आगे बढ़ती है।

6. यदि वकील की फीस देने में असमर्थ हों: यदि आप वकील की फीस भुगतान करने में असमर्थ है, उस स्थिति में आप जिला विधिक सेवा प्राधिकरण के कार्यालय में आवेदन देकर निःशुल्क विधिक सहायता एवं अधिवक्ता उपलब्ध कराने का अनुरोध कर सकते हैं। जिला विधिक सेवा प्राधिकरण के ऑफिस प्रत्येक कोर्ट में होते है।

What Are Your Options If the Police Refuse to Register Your Complaint?

If the police do not take any action on your complaint, the law provides you with several legal remedies. Following the proper procedure helps preserve an official record of your complaint and supports any future legal proceedings.

1. Submit Your Complaint at the Police Station: First, submit your written complaint to the concerned police station and ensure that you obtain an acknowledgment (receipt or diary number). Keep this acknowledgment safely for future reference.

2. If the Police Station Refuses to Accept the Complaint or Issue an Acknowledgment: If the police station refuses to accept your complaint or declines to provide an acknowledgment, personally visit the office of the Superintendent of Police (SP) of the concerned district. Submit your complaint there and obtain an acknowledgment (receipt or diary number). Preserve this document carefully for future use.

3. Send the Complaint by Post: You may also send your complaint to both the police station and the Superintendent of Police through Registered Post or Speed Post. In such cases, keep the postal receipt and a copy of the complaint safely, as these may serve as evidence in future legal proceedings.

4. Allow Reasonable Time for Action: After your complaint has been received, allow the police a reasonable opportunity to take the necessary action. If no action is taken within approximately eight days, or if you do not receive a satisfactory response, you may consider pursuing the next legal remedy.

5. File a Private Complaint Before the Court: If the police fail to act, you may file a Private Complaint before the competent lower court having jurisdiction over the matter. If possible, prepare and submit the application with the assistance of an advocate.

The Magistrate will examine your application and the available evidence. If the Magistrate finds that a prima facie case exists and that an inquiry is necessary, the court may, in accordance with law, direct the police to conduct an investigation or pass any other appropriate order. Thereafter, the proceedings will continue under the supervision of the court.

6. If You Cannot Afford Legal Fees: If you are unable to pay an advocate's fees, you may apply to the District Legal Services Authority (DLSA) for free legal aid and the appointment of a lawyer. District Legal Services Authority offices are available at every district court.
